Estate Administration

The death of a loved one often requires some form of legal action in the probate court. Family members or trusted friends are faced with the responsibility of ensuring accurate distribution to the rightful beneficiaries.

Successful accomplishment of the probate process needs a caring and experienced probate and estate administration attorney to guide and manage the probate process.  This process includes identification of heirs and beneficiaries as well as debts to be paid by or to the estate. Probate ends with a final accounting which must be approved by the judges sitting in the probate court.

If there is a will, the named executor is charged with the duties of administering the estate, which will be monitored by the probate court.  If there is no will, someone must be appointed by the probate court as an administrator for the estate. The same duties will apply to the administrator of an estate.

We begin with a confidential consultation at no cost to the client. Thereafter, our attorneys will perform all of the tasks from the initial filing through the completion of all probate court requirements, which ultimately ends with a final distribution of assets. 

If so required, we refer you to the appropriate source for the procurement of property valuations.  In addition, should the client elect to close the estate through the probate court, we will prepare the final accounting of assets.

In some instances probate may result in litigation brought by heirs or creditors. Our litigation department will assist clients in all forms of probate litigation to protect the rights of the estate, beneficiaries, heirs and creditors.

If the estate includes residential or commercial real estate our real estate departments are available to counsel you relative to the property’s retention, sale or rental.
