Family Law Mediation

Coming to terms that a relationship is ending is difficult. Deciding to separate or divorce can feel like a daunting, emotional, and confusing process where pitfalls await you if you are not prepared and know what you should be addressing. Each family situation is unique and each person handles it differently.

That is why mediation is a good alternative to litigation. "Divorce mediation is a process in which an impartial third party facilitates communication and negotiation and promotes voluntary decision making by the parties to the dispute." ABA Model Standards, August 2005

Our mediators will help you plan the terms of the dissolution of your relationship, and we understand and appreciate the emotional aspects of splitting up and moving on amicably, without the need for high cost litigation. Our mediators help you to manage the necessary and usually difficult negotiations in a way that serves you and your children's interests for the future.

By choosing to approach and finalize your legal issues through mediation, you will be participating in a collaborative and confidential process. You will work together with a neutral mediator in private sessions, usually lasting as long as you choose over a period of time that you choose. The process is voluntary and a mediator will guide you to explore options and plan your future.

When you are satisfied with the agreement reached through mediation, we prepare all the paperwork you need to file with court and will be there with you when you sign the required documents. Our mediators can assist you through filing the paperwork and appearing at court to enter the agreement in court.

There are many issues that couples need to address in their settlement, such as:

  • Identification of Separate Property
  • Application of Prenuptial or Antenuptial Agreement Terms
  • Division/Sale of Real Estate
  • Division of Marital Assets/Debts, including pension benefits and retirement accounts
  • Physical and Legal Custody of Children
  • Parenting Plans
  • Child Support
  • College Expenses
  • Health and Life Insurance
  • Alimony

Our mediators facilitate and guide you through identification of all necessary issues and interests, including those that you may not have previously considered.

Our mediators will maintain an environment that encourages open and honest discussions about all issues you feel are relevant. The mediation arena is confidential, and will encourage frank discussions of issues and emotions so that compromises can be made for an effective and long term resolution to your financial and family related issues. Because all of our mediators are also experienced litigators in family law, the final settlement reached will minimize the likelihood of future court proceedings where one or both parties found loopholes in the usual mediated agreement. In addition, the mediator's facilitated and directed negotiations empower the parties to create their own agreement. You thereby become emotionally invested in the final agreement, resulting in enhanced communication and a decreased likelihood of breakdowns in the future.

We are here to help you and look forward to assisting you through this process.
